1. Agreement to Terms
These Terms of Service ("Terms") form a binding agreement between you ("you," "your," or "User") and human.today, Inc. ("human.today," "we," "us," or "our"). They govern your access to and use of the human.today websites, the Life OS application, beta programs, content, communications, and any services we make available now or in the future (collectively, the "Services"). By creating an account, accessing our content, or using any portion of the Services, you agree to be bound by these Terms and all referenced policies. If you do not agree, do not use the Services.
2. The human.today Services
human.today delivers a personal operating system for growth in the AI era. Features include guided Belief Archeology™ experiences, journaling, mood tracking, daily practices, archetype assessments, AI-generated insights, shareable breakthroughs, and subscription offerings. We may enhance, update, or remove features over time. Some experiences may be labeled beta or experimental; they may change without notice and are provided as-is.
3. Eligibility & Account Registration
- You must be at least 13 years old to use the Services.
- Create your account using accurate, current information. You are responsible for maintaining the security of your credentials and for all activity that occurs under your account.
- Notify us immediately at support@human.todayif you suspect unauthorized access or security issues.
- We reserve the right to refuse service, close accounts, or reclaim usernames if they violate these Terms or our policies.
4. Acceptable Use
You may use the Services only for lawful, personal purposes and in accordance with our Acceptable Use Policy. Prohibited conduct includes (without limitation) attempting to gain unauthorized access, reverse engineering, or misusing AI features to generate harmful or discriminatory content. We may monitor for violations and take action including suspension or termination of your account.
5. Subscriptions, Trials & Payments
5.1 Billing & Pricing
- We offer free and paid tiers. Paid plans grant additional features and content.
- Prices, features, and payment schedules may change; we will provide advance notice when required.
- Payments are processed through Stripe. You authorize recurring charges until you cancel.
5.2 Trials & Promotions
- Trial offers convert to paid subscriptions unless cancelled before the renewal date.
- Promotional pricing is subject to the specific terms shared with the offer.
5.3 Cancellations & Refunds
- You may cancel anytime via your account settings. Access continues until the end of the current billing period.
- We provide a 7-day refund for first-time annual or monthly upgrades. Afterward, fees are non-refundable except as required by law.
- Outstanding balances must be paid even if your account is suspended or terminated.
6. Communications
By creating an account, you consent to receive transactional emails, account notifications, research invitations, and marketing messages as described in our Email & Communication Policy. You can modify your preferences or opt out of non-essential emails at any time.
7. User Content & License
You retain ownership of journals, reflections, insights, and other content you add to the Services ("User Content"). By submitting User Content, you grant human.today a worldwide, non-exclusive, royalty-free license to host, process, adapt, display, and create derivative works as needed to operate, improve, and promote the Services. We may generate anonymized or aggregated data derived from User Content; that data belongs to human.today.
8. AI Guidance & Wellness Disclaimer
- AI-generated insights are informational and do not constitute medical, legal, or financial advice.
- The Services are not therapy, counseling, or a substitute for professional support. Always seek qualified assistance for health or crisis situations.
- We do not guarantee specific results, outcomes, or transformations.
9. Third-Party Services
We rely on service providers such as Clerk (authentication), Stripe (billing), Convex (data platform), Vercel (hosting), PostHog (analytics), and Resend (email). Their services are subject to their own terms and privacy notices. We are not responsible for third-party failures or outages.
10. Privacy
Your privacy is important to us. Our Privacy Policydescribes how we collect and process personal information. By using the Services, you acknowledge that processing.
11. Termination
- You may stop using the Services at any time. Delete your account via settings or by contacting us.
- We may suspend or terminate access if you violate these Terms, our policies, or applicable law, or if your use risks harm to the community.
- Upon termination, sections that by nature should survive (including ownership, indemnity, disclaimers, and limitations of liability) will remain in effect.
12. Intellectual Property
The Services, including all content, software, branding, and designs, are owned by human.today or our licensors and protected by intellectual property laws. Except for the limited rights granted in these Terms, no other licenses are granted. Do not copy, distribute, or modify the Services without our permission.
13. Disclaimers
The Services are provided "as is" and "as available." human.today disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee uninterrupted or error-free operation.
14. Limitation of Liability
To the fullest extent permitted by law, human.today and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or business opportunities, arising from or related to your use of the Services. Our total liability for any claim will not exceed the greater of (a) the amounts you paid to us in the 12 months preceding the claim or (b) $100 USD.
15. Indemnification
You agree to indemnify and hold harmless human.today, our affiliates, and our team members from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your User Content, or your violation of these Terms or any applicable law.
16. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Delaware and the United States without regard to conflict of law principles. The parties consent to the exclusive jurisdiction of the state and federal courts located in New Castle County, Delaware for disputes that are not subject to informal resolution. Before filing suit, both parties agree to try in good faith to resolve disputes through direct negotiation within 30 days of written notice.
17. Changes to These Terms
We may update these Terms to reflect product changes or legal requirements. When we do, we will revise the "Last updated" date above and, when appropriate, provide additional notice. Continued use of the Services after revised Terms take effect constitutes acceptance.
